General Terms and Conditions of Contract
1. PURPOSE.
These General Terms and Conditions of Contract (hereinafter, GTCC) are intended to regulate the access to and acquisition of the products and services provided by Bodega y Viñedos Serapio, located at C/Austria, 14, 16630 – Mota del Cuervo (Cuenca), to the user through the website www.vinoserapio.com (hereinafter, the website), thus establishing the legal framework governing the contractual relationship between the parties.
By accepting these GTCC, the user guarantees that they are an individual of legal age, with full capacity to enter into contracts, and that they understand and accept these general conditions, agreeing to comply fully with them.
The GTCC shall be accessible to the user both prior to and after the contracting procedure of the products or services offered on the website, as they may be stored by the user. For each new purchase process, the user must read the GTCC again, as THE COMPANY may have modified their content.
THE COMPANY may modify the GTCC whenever necessary to expand the information related to its products or services, whether as an update or improvement, as well as to modify, replace, or update information regarding prices, conditions, or descriptions of the products or services offered on the website. The above description is not restrictive but merely illustrative, and therefore Bodega y Viñedos Serapio may modify the GTCC whenever it has sufficient reason or cause to do so, at its sole discretion.
2.- RIGHTS AND OBLIGATIONS OF THE PARTIES.
2a) Obligations of THE COMPANY:
THE COMPANY shall supply the requested product in accordance with good faith and in compliance with the provisions established in these terms and conditions of contract.
THE COMPANY shall inform the user of these GTCC at the beginning of the contracting process and shall make the full text available during and after the process.
Prior to the start of the contracting procedure, THE COMPANY shall inform the user clearly, precisely, and unequivocally of the specific characteristics of the requested services, such as their price and the applicable taxes.
THE COMPANY shall confirm to the user the successful completion of the purchase process by email sent to the contact address or by telephone, within a maximum period of 24 hours from the user’s acceptance of the terms of contract.
THE COMPANY shall be bound by the information provided to the client and must deliver the contracted products to the user under the terms stated.
2b) Obligations of the user:
The user guarantees that they are over 18 years of age.
The user guarantees that they have full legal capacity to enter into contracts.
The user shall complete the necessary forms to correctly manage the purchase process with truthful and accurate information, both regarding personal contact details and payment information or any other data requested.
The user shall pay the required price during the purchase process.
3.- OTHER INFORMATION PRIOR TO CONTRACTING.
The contract is formalized in Spanish, in accordance with these GTCC.
Offers shall remain valid for the period specified on the website in each case. In the event that stock is exhausted before the offer expiration date, a product or service of equivalent quality and price may be supplied by mutual agreement with the user.
The user may access the essential characteristics of each product through its description on the website.
The user accepts these GTCC, which will be sent by email upon completing the purchase. Therefore, the company will not store the electronic contract. In any case, these GTCC will remain permanently accessible on the website.
4.- PAYMENT METHOD.
The prices and fees applicable to the contracting of products or services offered on the website shall be those displayed at the time the user begins the contracting process. Product shipping costs are free of charge.
All prices and fees include applicable taxes. The invoice will be sent along with the order and will be in Spanish.
5.- NULLITY AND INEFFECTIVENESS OF CLAUSES
If any clause included in these conditions is declared totally or partially null or ineffective, such nullity shall affect only that specific provision or the part thereof that is null or ineffective, while all other conditions shall remain in force.
6.- APPLICABLE LAW AND JURISDICTION
The provision of the services on this WEBSITE and these terms of use are governed by Spanish law. The parties, expressly waiving any other jurisdiction that may correspond to them, agree to submit to the jurisdiction of the Spanish Courts and Tribunals.
